THE REGULATIONS.
These are the terms between you and the person who makes The Out Lap. They cover the app, its widgets and this website. Installing or using the app means you accept them. If you do not accept them, do not use the app.
01WHO YOU ARE AGREEING WITH
The Out Lap is made and published by David Overmeer, United Kingdom - "we" and "us" below. This agreement is between you and us, not Apple. Apple's App Store terms also apply to how you got the app, and Apple has the rights set out in section 11.
02YOUR LICENCE
We grant you a personal, non-exclusive, non-transferable licence to install and use The Out Lap on Apple-branded devices that you own or control, for your own non-commercial use, within the Usage Rules in Apple's App Store terms - including through Family Sharing where Apple allows it. The app is licensed to you, not sold.
03THE OUT LAP PRO
The Out Lap Pro is an auto-renewing subscription, billed yearly.
- The price is shown in the App Store and on the paywall before you buy, in your local currency, and is charged to your Apple ID when you confirm the purchase.
- It renews automatically for another year, at the price shown at the time, unless you cancel at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the period ends.
- Manage or cancel it in your device's Settings under your name, then Subscriptions, or in the App Store. Deleting the app does not cancel a subscription.
- Introductory offers, where shown at purchase, run for the period stated and then convert to the standard yearly price unless cancelled before they end. Apple decides who is eligible for an offer.
- Refunds are handled by Apple under Apple's terms. We cannot issue them; ask Apple at reportaproblem.apple.com.
- Restore Purchases on the paywall brings an existing subscription back on a device signed in to the same Apple ID.
- If a renewal price rises, Apple tells you in advance and, where required, asks for your agreement before charging.
04INDEPENDENT AND UNOFFICIAL
The Out Lap is an independent fan app. It is not affiliated with, endorsed by or associated with Formula 1, the FIA, Formula One Licensing B.V., or any team, driver, circuit or promoter. F1, FORMULA 1, FORMULA ONE, GRAND PRIX and related marks are trademarks of Formula One Licensing B.V. Driver, team and circuit names are used to identify real-world events and results, and for nothing else.
05THE DATA, AND WHAT IT IS FOR
Results, standings, calendars, timing and the sessions rebuilt from them come from public sources. They may contain errors, gaps or delays; a rebuilt session may differ from what was broadcast, and live sessions may lag. It is entertainment. Do not rely on it for betting, wagering or any decision involving money or safety.
The 8-bit characters in the paddock are stylised depictions. What they say and do in the app is invented for entertainment and is not attributed to, or endorsed by, the real people.
The 3D circuits are built from OpenStreetMap data, © OpenStreetMap contributors, licensed under the Open Database License (ODbL). Weather is by Open-Meteo.com, licensed CC BY 4.0. Maps are by Apple Maps. Each is subject to its own licence.
06WHAT IS OURS
The app - its design, code, engine, reconstructions, artwork, characters and words - is ours or licensed to us and is protected by copyright and other intellectual property law. These terms give you nothing beyond the licence in section 02. Third-party data and marks stay with their owners.
07WHAT YOU MAY NOT DO
- Copy, modify, reverse engineer, decompile or extract the source of the app or its data packs, except where the law lets you regardless of this clause.
- Scrape, harvest or bulk-download data from the app or our servers, or use it in another product or service.
- Sell, rent, lend, sublicense or otherwise commercialise the app, a subscription or anything in it.
- Interfere with our servers, or with anyone else's use of the app.
- Use the app for anything unlawful.
08AVAILABILITY AND CHANGES
The app depends on our servers and on third-party services, and any of them may be slow, interrupted or unavailable - particularly during a live session. We may add, change or remove features, data and content, take the service down for maintenance, and stop offering the app. If a change materially reduces what you have paid for, your remedy is to cancel and, where Apple's rules allow, ask Apple for a refund.
09NO WARRANTY
The app is provided as is. To the fullest extent the law allows, we do not warrant that it will be accurate, complete, uninterrupted or error-free, or fit for any particular purpose, and we exclude all implied warranties. If you are a consumer, nothing here affects your statutory rights, including under the Consumer Rights Act 2015 where you are in the UK; those rights stand regardless of these terms.
10LIMITATION OF LIABILITY
To the fullest extent the law allows, we are not liable for indirect or consequential loss, for loss of profit, data or opportunity, or for anything you do in reliance on data in the app; and our total liability for everything arising out of the app or these terms is limited to what you paid for your subscription in the twelve months before the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be excluded.
11APPLE
Apple requires the following of every app sold through the App Store under its own terms, and we agree to it:
- These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence covers use on Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, including through Family Sharing where Apple allows it.
- We, not Apple, are solely responsible for maintaining and supporting the app. Apple has no obligation to provide any maintenance or support for it.
- We, not Apple, are responsible for any product warranty, express or implied, to the extent not disclaimed above. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
- If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country, and that you are not on any United States Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app - your mobile network's terms, for instance.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

12ENDING THIS AGREEMENT
You can end this agreement at any time by deleting the app and cancelling any subscription in Settings. We may end it, or suspend your access, if you break these terms. Sections 04 to 11 and 13 survive the end of the agreement.
13GOVERNING LAW
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute - except that if you live elsewhere in the United Kingdom or in the European Union, you keep the protection of the mandatory consumer rules of the country where you live and may bring a claim in its courts.
14CHANGES TO THESE TERMS
We may update these terms. The date at the top moves, and the current version always lives at theoutlap.app/terms. If you keep using the app after a change, the changed terms apply to you.
